1. 1. General:

    To ensure the smooth running of smartManiacs, we require all users to read and abide by the following rules. Please note that these are not to be seen as constrictive; they are merely here to protect other forum users and make this a friendly place for all. Please note that these rules are subject to change as the site evolves. Any changes will be posted up publically to make all our users aware. Generally, the overarching principal rules are:

    1.1 Treat other members how you would expect to be treated yourself.

    1.2 Give the site administrators and moderators respect. They are not paid for this job!

    1.3 Do not attempt to undermine the reputation and responsibilities of smartManiacs.


  3. 2. User Registration:

    2.1 Each member is allowed only one login account. Special arrangements may be made for sponsors to distinguish between personal and business accounts. Standard members registering with multiple accounts will be asked to choose one account only. Persistent offences may result in a ban from smartManiacs.

    2.2 Think about your user ID before you create it. Offensive IDs will be removed.

    2.3 Do not use an ID that corresponds to a company title, company name, email address or URL for a service that you or anyone else may provide or sell. Special arrangements may be made for site sponsors, upon request.

    2.4 For your own safety, we advise against choosing a vehicle registration plate ID as your user ID.

    2.5 Please ensure that your registered email address is up to date at all times. This is required so that a forum moderator or administrator can get in contact with you, if needed. smartManiacs will not be held responsible for any consequential administrative decisions made if you cannot be contacted.

    2.6 Keep your login details secure at all times. Never disclose your password verbally, by email or publically on the forums. Again, smartManiacs cannot be held responsible for careless disclosure of these details.


  5. 3. Forum Content:

    The forums should be a friendly place where members can freely discuss technical aspects or as a social hub. Compared to actual discussion, the forums have a fundamental difference that what you post is available for the whole world to see. Therefore, please be mindful about what you post. Think how it will come across to others. Some users / forums require moderator approval before their post can be made public. If you see a notice saying that a post has been held for approval, please do not post up again. A moderator will be along shortly. The following rules apply:

    3.1 All members are responsible for their posts.

    3.2 Please ensure that images contained within the body of the post are no wider than 800px. This is to avoid distorting the appearance of the forum.

    3.3 The smartManiacs moderation and administration team reserve the right to remove any post, topic, thread, poll posted on the public forums without prior notice.

    3.4 Advertising (unless an agreement is in place), spamming and trolling are not allowed. This includes using the forum email and Private Message system to spam/advertise other members. Persistent offenders will be removed from the site.

    3.5 Any post that contains a potentially libellous statement will be removed without notice and the poster given a warning via a Personal Message. Continued posts of such a nature may mean the poster will be permanently banned from smartManiacs.

    3.6 Discussion of criminal and illegal activities, including but not limited to, software and music piracy and other intellectual property violations are not allowed as are links to download locations of copyrighted material.

    3.7 Any discussions relating to bypassing a car’s physical and/or electronic security systems will be removed immediately.

    3.8 Posting of copyrighted material is not permitted. Exceptions apply if you are the copyright owner or if you have been given consent from the owner of the copyrighted material. Any content of this type that is posted may be removed without prior notice.

    3.9 Posts (or URLs within posts) containing any of the following may be removed or edited at the discretion of a moderator:

      a. Sexual images / Videos

      b. False subject matter

      c. Defamatory material

      d. Hateful content

      e. Personal attacks on other members

    3.10 Many of our users view the forums from a work computer or through a network that is monitored. If you are posting a new thread which may have ‘questionable’ content, please add the acronym “NSFW” (Not Safe For Work) before the title of your thread.

    3.11 Posting personal contact details of any other user / member / sponsor without their permission is not allowed and will result in a permanent ban from smartManiacs.

    3.12 No investment advice of any kind is allowed to be published on the forums. After consultation with the FSA it is the understanding of smartManiacs that this could contravene FSA regulations. Posts requesting or offering specific investment advice will be removed without notice.

    3.13 Items for sale should only be posted to smartManiacs Sales & Wants. An entry in Classifieds must be for personal use only, unless commercial advertising is approved. Please note, if you do not subscribe to the site supporter service, you post will be subject to approval by a moderator.


  7. 4. Avatars & Signatures

    An avatar is the small graphic next to a users name. Use of these is optional and can be configured in the user control panel. A signature may be text, a graphic, or both, and is automatically pasted beneath a user’s post. The rules in “Forum Content” apply to avatars and signatures, with the following additions:

    4.1 Signatures are reserved for those users in the site supporter subscription service.

    4.2 Avatars and signatures must not contain any text or URLs linking to external businesses. Site sponsors may only link to their own business. Any hidden URLs embedded in signatures will be considered trolling and may result in a ban from smartManiacs.

    4.3 The maximum total signature size is 70 pixels high and 600 pixels wide. The reason for this is to keep signature images and text from dominating a thread and interrupting other readers' enjoyment of it. To that end, the Moderators kindly ask that you keep this in mind as they may request that any signature that is overbearing be changed.

    4.4 All avatars must be no larger than 65 pixels wide and 65 pixels high.


  9. 5. Moderator/Administrator responsibilities:

    The moderators and administrators of smartManiacs are all volunteers. Therefore, we kindly ask that you respect their approach and support their efforts in managing the forums. Moderators and administrators would prefer not to intervene, however should they do, you will accept the following:

    5.1 In the event of a thread being closed, or your post moderated, you will not post up another thread asking why. If you have any concerns or questions, you must message a moderator or administrator who will explain.

    5.2 Any public calls for moderation will be ignored. To report a post or thread, please report the thread by clicking the warning triangle icon next to the particular post. By doing this, you will alert all moderators and administrators to the problem. The matter will be dealt with in strict confidence.

    5.3 The moderation and administration team reserve the right to invoke a ban on anyone who willfully and wantonly violates any of the forum rules.

    5.4 The team also reserves the right to take any actions that are deemed appropriate to ensure these forums are not disrupted or abused in any way; this may be over and above the explicit rules.

    5.5 The team shall be the sole arbiters of what constitutes a reason for banning, and in banning the user(s) the duration of any ban is also at the entirely discretion of the smartManiacs administration and moderation team.

    5.6 In certain circumstances, an administrator or moderator may invoke an immediate ban on a user or users. When this occurs, all team members will discuss the reason before a final decision is made. This may either result in the ban being extended or relaxed.

    5.7 Whilst users may express their opinion to the smartManiacs administration team concerning the validity or duration or a ban, excessive abuse of this privilege may be considered harassment, and may result in complete exclusion from the site.

    5.8 Users agree to refrain from interfering with any action by any smartManiacs representative to redress any violation of these Terms and Conditions.

    5.9 Any request to have your account deleted will be declined.


  11. 6. Use of smartManiacs:

    6.1 Any reproduction of the smartManiacs name and logo is prohibited without the express written approval of the administration team. Please message an administrator if you require use of either. Any decisions will be respected.

    6.2 You agree not to impersonate any person or entity, including, but not limited to, a smartManiacs administrator or moderator, or falsely state or otherwise misrepresent your affiliation with a person or entity.

    6.3 Attempts to divert the smartManiacs member base to other forums or websites are not allowed. Forms of diversion include but are not limited to the following:

      a. Repetitive links in forum posts.

      b. Abuse of the Personal Message system

      c. Statements in user profiles

      d. Blatant redirection links in signatures or avatars Persistent offenders will be banned from smartManiacs without question.


  13. 7. Disclaimer & Legal Rules:

    1. 7.1 SmartManiacs accepts no responsibility for the opinions and information posted on this forum by others. SmartManiacs disclaims all warranties with regards to information posted, whether posted by SmartManiacs or any third party. This disclaimer includes all implied warranties of merchantability and fitness. In no event shall SmartManiacs, its owners, administrators, moderators or members be liable for any special, indirect or consequential loss or damages or damages whatsoever resulting arising in any circumstance.
    2. 7.2 You acknowledge and agree that you use and/or rely on any information obtained through the discussion forums at your own risk. SmartManiacs is not in any manner endorsing the content of the discussion groups and cannot and will not vouch for its reliability.
    3. 7.3 The disclaimer of liability contained in this section applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, negligence, or under any other cause of action.
    4. 7.4 Through your use of this site you agree to indemnify SmartManiacs, its affiliates, sponsors, administrators, moderators, and licensors from any claims, proceedings, actions, liabilities, expenses, costs, losses or damage resulting from your use howsoever caused.
    5. 7.5 The above Terms & Conditions are governed by and construed in accordance with laws of the United Kingdom and all Users submit to the jurisdiction of its courts.
