"in good condition" is open to interpretation yes

did it smell all fresh and mint?

But did you take photos? I'm sorry to say but the cost of small claims court v £200 isn't worth the hassle. Do remember, they can ask for any court case to be moved closer to them, so you may start something in Bristol but expect it to be closer to Manchester. Just walk away, do some internet bad mouthing, advertise something (or lots of things) on Gumtree for them that'll have their phones ringing off the hook - a deceased estate Mk2 RS2000 for £500 should do it, or even an RS Mexico garage find needing restored. Try a copy of Stadium Events for NES, unopened for £50 too ...

I once kept a deposit from a buyer who didn't complete on a sale. He changed his mind! I kept his money.

Yup - I have photos of a number of bits.

You get all costs back at the end (if you win)

I've given then 7 days to respond.

well, show us the pics then!

You don't get all costs back - you get a proportion of the monetary value that may go to 100% but pretty much nothing for your time and effort. It'll cost £600 or so to get to the stage that you may win the case.

I'd walk away, I really would (while using their telephone numbers for some spoof adverts)

Next time, I suggest you don't pay a deposit on the assumption that only an idiot* would buy a forfour and therefore the chances of it selling were negligible!

Also, I'd always get it in writing that the deposit would be refundable if the car wasn't up to scratch.

*Other types of buyer are available!

Mr Schmitt offers good advice. I'd take it.

You have been treated badly JJ, but you risk losing a lot more. Learn a little cynicism for your future dealings. The world isn't always nice - know it.

Re: Warning: ACS Cars in Accrington

Thanks guys, your help has allowed me to track done contact details and routes to claim my money back and I think as you have set out, I have enough images and evidence to put a very good case together.

Can a moderator please now lock this thread until I have completed the legal action.

              Thanks

Re: Warning: ACS Cars in Accrington

What annoys me, as I've swapped a lot of cars before is, that buyers seem to dislike honesty/full briefings.

I had a peugeot 306 that took ages on ebay to sell and when it did, I got less than others seemed to. Instead of putting one line of text about it though, I put all the regular maintenance it had had done, what might need doing in the future, what doesn't need worrying about, etc etc. I always try to be honest, maybe that's where I am going wrong :p Seriously though, I'd prefer not to muck someone about.

Seems the more information you give, the more people switch off. Annoys me people that don't read. Like when I went to sell my auto mx-5, it said in the info, automatic! So someone bids and wins, comes to collect and then walks when they see it is an auto box, it's the first line in the description!

Anyway good luck sorting out those charlatans PC.
