ESP light on ForFour

We have a minor problem on my partner Lindas forFour, which occurs regularly
for the past few months for her but I have never witnessed? despite the fact
I borrow her car on a near daily basis.....

When she starts the car the ESP light often stays on but will always
clear if she switches the engine off and restarts immediately.

She believes she noticed it shortly after having her discs + pads
changed at a garage and it generally but not exclusively occurs when
she sets off to work/first uses the car.

So it would appear temperature related but any other suggestions?

If its temp related, is the battery suffering and causing the ESP error?
